Status Update on Receivership of Eshaq M. Nawabi, individually and d/b/a Nawabi Enterprise, and Hyperion Consulting, Inc.

Pursuant to the Damages Consent Order entered in CFTC v. Eshaq Nawabi, et al., the United States District Court has:

  • Lifted the asset freeze previously imposed on Mr. Nawabi;
  • Approved a final resolution of claims brought by the Commodity Futures Trading Commission (“CFTC”); and
  • Directed that any claims for restitution, damages, or penalties be submitted not to the Receiver, but instead to the party and address specified in the Consent Order.

Important Notice to Claimants

As a result of the Consent Order:

  • The Receivership Estate holds no remaining assets for distribution.
  • The Receiver is no longer accepting claims or communications concerning the recovery of funds.
  • All claimants seeking restitution must refer to the final Damages Consent Order and submit inquiries or claims directly to:
